All entries, whether submitted by making an eligible Upromise purchase or via 3"x 5" mail-in entry as described below, have an equal chance of winning. Eligibility: Sweepstakes only open to Upromise members as of 9/30/06 who are legal residents of the 50 United States or the District of Columbia, 18 years of age or older as of 10/1/06. Employees, officers, directors, agents & representatives of Upromise, Inc. ("Sponsor") & each of its respective parent companies, affiliates, distributors, subsidiaries, retailers, advertising/promotion agencies, & Project Support Team, Inc. ("P/S/T") (collectively, "Released Parties") & members of the immediate family (mother, father, brothers, sisters, sons, daughters & spouse, regardless of where they reside) & household members of any such individual, whether or not related, are not eligible to participate. This Sweepstakes is subject to all applicable federal, state, & local laws & regulations. Void where prohibited. How to Enter: Sweepstakes begins at 12:00:01AM Eastern Time ("ET") on 10/1/06 & ends at 11:59:59PM ET on 10/31/06 ("Promotion Period"). 1) Automatically receive (1) Sweepstakes entry for each positive value college savings contribution that posts to your member Upromise account as a result of an eligible online purchase made during the Promotion Period. College savings can be earned for an online purchase only if that purchase is trackable by Upromise, meaning that the purchase was made at a participating online retailer after first: a) clicking to the retailer's site from Upromise.com; b) clicking to the retailer's site from an email sent by Upromise; or c) being redirected to the retailer's site with tracking information included automatically from having either RemindU or the Upromise Toolbar installed & in use. Online purchases made directly from a participating retailer's site without following any of the scenarios described above will not receive college savings contribution & will not be eligible for automatic entry. Some partner retailers do not offer contributions on all purchases. If you do not receive a college savings contribution with respect to your online purchase, you will not be eligible for an automatic entry for that purchase. Online purchases made from select partners whereby a registered credit or debit card is needed to receive Upromise rewards are not eligible for automatic entry. These partners are: Avis, Bed Bath & Beyond®, Budget, Cryo-Cell, Eddie Bauer®, Eddie Bauer Outlet, The Sharper Image®, & Upromise Cruises. 2) To enter the Sweepstakes without making a purchase & receive (1) Sweepstakes entry, hand print your name, complete mailing address, telephone number, date of birth & Upromise account number on a plain 3"x 5" piece of paper & mail it in a sealed, stamped & hand printed #10 envelope to: The Upromise October Online Sweepstakes, P.O. Box 16092, Bridgeport, CT 06673-6092. Enter as often as you wish by mail, but each entry must be mailed separately & be received by 11/7/06. No photocopied, computer generated facsimiles, mechanically reproduced, or mass entries permitted & all such entries will be void. All entries become property of Sponsor & will not be acknowledged or returned. Your making of an eligible Upromise college savings contribution purchase and/or your submission of a 3" x 5" mail-in entry constitutes your consent to participate in this Sweepstakes & your consent for Sponsor to obtain, use, & transfer your name, address & other information for the purpose of administering this Sweepstakes. Released Parties are not responsible for lost, incomplete, illegible, late, misdirected, stolen, inaccurate, postage-due, or mutilated entries, transactions or mail; any error, omission, interruption, defect or delay in transmission, 3rd party transaction classification, transaction processing, or communication; technical or mechanical malfunctions; failures or malfunctions of phones, phone lines, or telephone systems; printing, typographical, or other errors in these Official Rules, in any Sweepstakes-related advertisements or other materials; human-processing error; failures of electronic equipment, computer hardware or software; or inaccurate entry information, whether caused by equipment, programming used in this Sweepstakes, human error, or for any other error of any kind, whether network, technical, mechanical, human or otherwise, including, without limitation, errors which may occur in connection with the administration of the Sweepstakes, the processing of entries, or the inability to access any retailer's website due to technical issues. Sponsor reserves the right, in its sole discretion, to void any & all entries of an entrant (& disqualify him/her) who Sponsor believes has attempted to tamper with or impair the administration, security, fairness, or proper play of this Sweepstakes or who is otherwise not in compliance with these Official Rules. (31) Grand Prizes: A $1,000 College Savings prize awarded as an electronic deposit to winner's Upromise account. Prize will be awarded to winner's Upromise account within (8) weeks following verification. Prize is subject to terms & conditions of the Upromise membership. Total ARV of all prizes=$31,000. Federal, state, & local taxes & all other costs & expenses associated with prize acceptance & use not specified herein are each winner's sole responsibility. Winner Selection: Potential winners will be selected in a random drawing on or about 2/1/07 from among all eligible entries received by P/S/T, an independent judging organization whose decisions will be final & binding in all matters relating to this Sweepstakes. In the event that a potential winner is selected via a Upromise college savings contribution purchase, prize will be awarded to the person (as determined by Upromise's account records) named on the applicable Upromise account used to make the entry. Odds of winning will depend on the number of eligible entries received. Limit one prize per person, immediate family member, or household. Miscellaneous: No transfer, assignment, cash redemption, or substitution of prizes except by Sponsor who reserves the right to substitute a prize of comparable or greater value, at its discretion. Potential winners will be notified by email, telephone and/or mail. Potential winners will be required to execute & return an Affidavit of Eligibility, Liability Release & (where legal) Publicity Release within five days of date of issuance of notification. If prize notification is returned as unclaimed or undeliverable to a potential winner, potential winner fails to return requisite documents within the specified time period, or a potential winner is not in compliance with these Official Rules, such potential winner will forfeit his or her prize &, at Sponsor's sole discretion, an alternate winner may be selected for the prize at issue. Noncompliance with any of the foregoing may result in disqualification. By participating, entrants agree to be bound by these Official Rules & the decisions of the Sponsor & judges which are final & binding & agree that: 1.) Released Parties & their designees & assigns shall have the right & permission to use (unless prohibited by law) their name, voice, city/state of residence, photograph, and/or likeness for advertising and/or trade and/or any other purpose in any media or format now or hereafter known worldwide in perpetuity without further compensation, permission or notification & 2.) Released Parties & their designees & assigns shall have no liability & will be held harmless by entrant for any liability, loss, injury, or damage to themselves or any other person or entity, including personal injury, death or damage to personal or real property, to entrant or any other person or entity due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of the prize or participation in this Sweepstakes. If this Sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right in its sole discretion, to disqualify any individual who it believes has tampered with the entry process (& void his/her entry), and/or to cancel, terminate, modify or suspend the Sweepstakes (or any portion thereof). In the event of cancellation or termination, Sponsor may, in its sole discretion, select winners from among all eligible, non-suspect entries received prior to the event requiring such cancellation or termination.
